Services:
Supernet is a brand name of Supernet Limited (formerly PDS Limited),
a public limited company established and existing under laws of
Islamic Republic of Pakistan having its principal place of business
located at 75 East Blue Area, Fazal-ul-Haq Road, Islamabad, Pakistan.
("Supernet") subject to the terms and conditions contained
herein ("Terms") will provide Internet service ("Services")
to the applicant whose name and address appears in the Application
Form of which this is a part ("Customer"), which will
include access to Internet and any other services as introduced
in this regard by Supernet and intimated to the Customer. Supernet
reserves the right to accept or reject any application without assigning
any reason.
Payment Terms:
- The Customer will be provided with User ID ("User ID")
and a password ("Password") on the advance payment of
charges, account will be opened ("Created") in the name
of the Customer ("Account"). As soon as these charges
are credited into the system the account will be activated and
the Customer will be able to avail the Services.
- Subsequent fees and charges are also payable in advance. (All
charges are also payable are hereinafter refereed to as "Charges").
- Any Charges due on and NOT paid by the Customer will result
in suspension of the Services by Supernet.
- Supernet has the sole authority to cancel the Services and
assign Customer's User ID and e-mail address to any third person
("Third Party") on account of non-payment of any Charges
by the Customer.
Password:
- The Customer shall not disclose the Password to any Third Party
and Supernet will not be liable for any losses or the time utilized
from the Account in case any person other than the Customer uses
the Password.
- Supernet reserves its right to change the Password at any time,
without notice or assigning any reason to the Customer.
- It is the responsibility of the Customer to at once change the
Password assigned by Supernet on the activation of the Account
and thereafter change the Password at regular intervals.
Account Deletion:
- All accounts that have zero balance and have not been logged
in using a dial-up connection of Supernet ("Used") for
a period of 45 days will be treated as dormant accounts ("Dormant
Accounts").
- All accounts that have a balance of less than Rs. 200 rupees
("Minimum balance") and have not been Used for a period
of 90 days will be treated as inactive accounts ("Inactive
Accounts").
- All accounts, which have not been Used for more than a period
of 180 days, will be treated as orphan accounts ("Orphan
Accounts").
- All Dormant Accounts, Inactive Accounts & Orphan Accounts
will be deleted at the end of the their specified periods and
their User ID and e-mail address may be assigned to any third
person.
Terms of the Services:
- These terms will remain in force from the date the account is
created till Services are terminated according to the Terms. Supernet
shall terminate the Services In any of these events:
- Non-payment of the charges on time.
- Accounts qualifying for the Account Deletion policy.
- Breach of any of the terms.
- The Customer may request Supernet to terminate the Services
in the event he/she no longer wants to avail the Services, provided
all the outstanding fees and charges if any are paid by the Customer.
However, no Charges or Subscription fees will be refunded to the
Customer, in case the Services have not been utilized for the
period in respect of which advance payment has already been made.
- When all the balance of Account is exhausted, Services will
be suspended and the User will not be able to access his/her e-mails.
- Supernet reserves the right to change the pricing, modify/supplement/withdraw
any product or service without giving any reason or notice to
the Customer.
Customer responsibilities and undertaking:
- The Customer undertakes that he/she will not use the Services
for any unlawful purpose.
- Will not infringe any copyright or patent laws or any other
Laws for the time being in force.
- Will not use the Services in any way that will cause nuisance,
annoyance, threat or inconvenience, to any person.
- Will not try to gain unauthorized access to any computer
systems, networks or databases or use the password/code number
of any other person.
- Will not gain or attempt to gain access to any computer
system connected to the Internet, or to any private information
or resource not accessible to him/her without the prior consent
of the owners or holders of the right to this information,
system or resource.
- Will not indulge in any activity, which can be described
as hacking.
- Will not send any messages that are offensive on moral,
religious, racial, or political grounds or are obscene or
are intended to damage the national Interest.
- Will obtain, install, and maintain suitable equipment/computer
for availing the Services and arrange telephone line and comply
with any other specification as stipulated by Supernet with
respect to the computer used by the Customer for availing
the Services.
- Will not transfer any electronic virus to Supernet computer
systems or the Internet.
- Will not indulge in any activity, which is contrary to Internet
etiquette e.g. spamming and that which causes harm to normal
activity of the network.
- Will not assign the Services herein agreed to be provided
or trade on connectivity, resell, hire, transfer, assign or
otherwise allow any third party to use the Services.
- Agrees to receive e-mails from Supernet and other carefully
selected business.
- Customer agrees to comply with all the applicable laws
of Islamic Republic of Pakistan governing the terms.
Supernet's Disclaimer:
Supernet will not be responsible for any loss of information or
data caused as a result of any interruption, suspension or termination
of the Service or any act of the Third Party. Supernet is not in
any way liable or responsible for the inability-of the Customer
to use the services provided by Supernet, if this is due to reason
at and defect in the computer or software used by the Customer for
the purpose for availing Services or in case of Supernet makes any
changes to its networks and the Customer's equipment/software becomes
incompatible with the changes by reason of which the Customer cannot
avail the Services or if Service is suspended in accordance with
terms.
Indemnity:
Customer shall indemnify Supernet, its officers and representatives,
and its subcontractors from all liability disclaimed by Supernet,
as specified herein, arising in connection with the provision of
Services hereunder by Supernet to Customer, where such liability
is alleged to have been caused by an act or omission of the Customer,
or its agents and shall protect and defend Supernet, its officers
and representatives, and its subcontractors from any suit or claim
alleging such liability, and shall pay all expenses and satisfy
any judgment that may be incurred by or rendered against Supernet,
its officers and representatives, or its subcontractors in connection
therewith. Supernet shall notify Customer of any such suit or claim
against Supernet, its officers and representatives, or its subcontractors.
Customer agrees not to enter into any settlement of any such suit
or claim without first securing the written consent of Supernet
to the terms of such settlement, which consent shall not be unreasonably
withheld.
Variation:
Supernet can vary the Terms contained herein without giving any
reason or prior notice to the Customer.
Governing Law:
The Laws of Islamic Republic of Pakistan will govern these terms
and Courts of Islamic Republic of Pakistan will have non-exclusive
jurisdiction over any dispute arising from these terms.
Force Majuere:
Supernet shall not be liable for any breach of the terms, for the
delay of non-performance of the terms, arising out of defect in
its network/ system not within its control or which cannot be rectified
or discontinuance of general day to day business activities in Pakistan,
an account of any strike, lock-out, riots, terrorism, war, insurrection,
civil commotion, economic, political, military or financial crises
or situation or any act of God or other reason not within the control
of Supernet or any breakdown of any of the component of the system
of Supernet, which is used to provide the Services and which is
not within the control of Supernet.
Other terms:
Supernet does not guarantee, represent or undertake any responsibility
for any specific response time or speed for gaining access to the
be internet or the availability of the modem lines. Supernet reserves
the right to suspend the Services for the scheduled or unscheduled
maintenance work, repairs etc without giving any notice. All the
notices by the parties will be given through e-mail/registered post
at the address of the parties herein above or any change in the
address stipulated to the other party. The Government of Pakistan
or any of its agencies has full authority to examine any data or
any communication of the Customer.
